PRIVACY POLICY

Privacy

The purpose of this policy is to summarise the obligations and principles, which Synchro Marketing has undertaken in order to control and protect personal and private information and comply with the following Australian and International Laws:

  1. Privacy Act 1988 (AU)
  2. SPAM Act 2003 (AU). 

 Generally, we use the information we collect about you for two purposes: 

  1. to facilitate your participation in ContiClub Rewards and 
  2. to create a better, more personalised experience for you. 

Our electronic commerce and privacy standards are derived from the world's best business practices and we abide by the following principles: 

 

Information Collection and Use

There are several ways in which we collect personal information. As much as possible, we will collect your information directly from you by means of registration, completion of forms, surveys or emails, as part of an order for products or services, inquiries and in situations in which you have chosen to provide the information to us. 

To enable us to successfully manage ContiClub Rewards we may also collect personal information from Continental Tyres of Australia Pty Ltd, or your employer, such as your employment details, work contact details and performance results. If we collect details about you from someone else, we will, whenever possible, make sure you know we have done this and why. If at any time you would like to correct this information, please contact info@ContiClub.com.au.

When you register with ContiClub Rewards and sign in to the website, app or access email communications, you are not anonymous to us. We only collect information that is necessary for what we do.  For example, we require address details to distribute rewards earned through ContiClub.

ContiClub Rewards automatically receives and records information from your computer and browser, including your details, IP address, cookie information, software and hardware attributes, and the page(s) you access to:

  1. improve our services, web site and online experience
  2. provide reporting for internal use and Continental Tyres of Australia Pty Ltd.

If you do not wish for information to be collected through the use of cookies, you can disable, remove or block the use of cookies in your internet browser.

 

Information Sharing and Disclosure

To be clear, the information we collect is shared with Continental Tyres of Australia Pty Ltd.
We do not rent, sell, or share personal information about you with other people or non-affiliated companies except to effectively manage the program and provide products or services you've requested, when we have your permission, or under the following circumstances:

  • We provide the information to trusted partners who work on behalf of or with Synchro Marketing or Continental Tyres of Australia Pty Ltd under confidentiality agreements. These companies may use your personal information to distribute Reward Claims, or personalised communications. However, these companies do not have any independent right to share this information. 
  • We respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims.

We do not transfer personal information to overseas recipients. If we are ever in a position where we may need to transfer your personal information to an overseas recipient, where practical, we will notify and seek inferred or expressed consent from you and ensure the foreign organisation/recipients of the data handle it in accordance with the Privacy Act and where required, the provisions of the GDPR.

Terms and Conditions

TERMS & CONDITIONS 

General Terms

  1. All aspects of the ContiClub Rewards Program (‘the Program’) form part of the Terms and Conditions of the Program. In the event of any discrepancy between Program information material and the following Terms and Conditions, these Terms and Conditions will apply.
  2. The Program Administrator is Synchro Marketing Pty Ltd ABN 33 064 655 750.
  3. The Program Sponsor of ContiClub Rewards is Continental Tyres of Australia Pty Ltd.
  4. The Program Administrator and Program Sponsor presents this Program in good faith and shall in no way be liable for any failure on their part to complete the Program, which may result from any cause whatsoever.
  5. The Program Administrator and Program Sponsor assumes no responsibility for any loss of whatever nature resulting from participation within the Program.
  6. The Program Administrator and Program Sponsor reserves the right to suspend or terminate the Program at any time they deem appropriate. In such a case, reasonable steps will be taken to provide advanced written notice (via electronic correspondence) with all existing Program participants.
  7. ‘Participants’ are defined as invited Tyre Retailers and OEM Car Dealership Managers, buying nominated Continental Tyres, who have been invited by the Program Administrator and Program Sponsor to register for participation.
  8. The Program is subject to the stated Terms and Conditions and failure to comply with these Terms, including any abuse of the Reward Points earning criteria or any misrepresentation of information to the Program Administrator will, without limiting the Program Administrator’s or Program Sponsor’s rights, result in termination of participation in the Program.

 

Program Period

The Program commences on 1 December, 2023 and will operate in its current form until 31 December, 2024.

 

Eligible Participants and Enrolment 

  1. Invited Participants will receive an email with a registration link from the Program Administrator and/or the Program Sponsor inviting them to register on the Program website – www.ContiClub.com.au. 
  2. To participate in the Program, invited Participants must complete their Program Registration by confirming their details on the Program Website on their first login – including reading and accepting the Program Terms and Conditions. All Participant information is stored in the Program database at the office of the Program Administrator. Please refer to the Program Data Security and Privacy Statement.
  3. If for any reason, the Program Administrator or the Program Sponsor are no longer able to provide the Program in its current form, the Program Administrator, and the Program Sponsor reserve the right to amend any part of the Program as required for its continued operation or to terminate the Program. In this event, the Program Administrator will notify Participants and to the extent permitted by law, the Program Administrator and Program Sponsor shall not be held liable for any loss or damage suffered by Participants resulting from such withdrawal, cancellation, variation or change.
  4. The Program Administrator and Program Sponsor abide by Federal and State Privacy and Data Protection Legislation. Data collected can only be used for the purpose it was intended and cannot be passed on to third parties. Click here for more information regarding your security and privacy when using this website. Earning Reward Points

  1. Each Program Participant is eligible to earn ‘ContiClub Reward Points’ for every nominated Continental Tyre purchases, as per the following matrix:
  •  Product  Rewards
     Nominated Continental Tyre  5 Reward Points per Tyre Purchased = $1.00 AUD in reward value.
  1. Continental Tyres or the Program Administrator reserve the right to change the participating Products or the Reward earnings ratio at any time. Program Participants will be notified in writing of any changes. 
  2. The Program Administrator or the Program Sponsor reserve the right to audit the purchases and associated Reward Point earnings at any time. Please see clause 8 relating to termination of participation in the event of any breach of these Terms and Conditions.
  3. ‘Purchased’ refers to Orders placed by the Retailer/Dealership and fulfilled by Continental Tyres of Australia. ‘Reward Points’ are issued on purchase and tracked by order date. Only purchases from Continental Tyres of Australia will earn 'Reward Points’ for the Participant.
  4. Each month, when Reward Point values have been calculated and issued to Program Participants, an individual ‘Activity Statement’ will be emailed to each Program Participant. A detailed view of Purchase Activity and Reward Point earnings will also be available on the Program Website.
  5. ‘Reward Points’ earned in the Program will expire, or be forfeited, under the following conditions:
    1. All ‘Reward Points’ are forfeited if the Participant becomes ‘inactive’ (i.e., leaves the OEM Dealership) – defined as not being an eligible Program Participant.
    2. Unless advised otherwise, all ‘Reward Points’ will expire if they have not been redeemed for a reward within 3 months of the end of each calendar year period of the Program. For example, ‘Reward Points’ earned in the period 1 January 2024 to 31 December 2024 must be redeemed for a reward by midnight 31 March 2025.
  6. The Program Administrator’s decision on ‘Reward Point’ allocation is final and no correspondence will be entered into. In relation to the interpretation of Terms and Conditions and any phrases describing this Program, the decision of the Program Administrator is final.

  7. A Participant’s ‘Reward Points’ cannot be transferred to another Participant – nor can they be exchanged for cash.

  8. The ‘Reward Point’ value of merchandise offered in the Program ‘Choose Your Reward®’ Catalogue is based on current market retail pricing. Please note: Pricing / ‘Reward Point’ value is subject to change without notice.

  9. ‘Reward Points’ awarded are subject to an audit at the discretion of the Program Administrator and Program Sponsor during or subsequent to the completion of the Program. If a violation of these Terms and Conditions is found, the offending Participant will, without limiting the Program Administrator’s or Program Sponsor’s rights, have their participation terminated.

 

Redeeming Program Rewards (‘Choose your Reward®’)

  1. All Rewards are subject to availability.
  2. How to redeem ‘Reward Points’ for Rewards using the Program Website:
    1. The ‘Choose You Reward®’ Catalogue on the Program Website will show the rewards that are available for redemption.
    2. To redeem any rewards using the Program Website, you must:
      1. Enter a valid Continental Tyres Customer Number and Password;
      2. Select the rewards you wish to order;
      3. Have sufficient ‘Reward Points’ available to redeem those items selected;
      4. Confirm your order and delivery address.
    3. You acknowledge and agree that once a reward order is confirmed by you, the Program Administrator will reduce the number of ‘Reward Points’ held by you by the number of ‘Reward Points’ required to purchase your chosen reward as shown on the Program Website at the time you confirmed your order.
    4. The Program Administrator will provide confirmation of receipt of your order in the form of a Confirmation Email.
  3. The terms on which you redeem the Rewards:
    ‘Reward Points’ earned in the Program can be redeemed for Digital Gift Cards and Lifestyle Merchandise reward via the ‘Choose Your Reward®’ Catalogue on the Program website.
    1. Rewards offered through the Program Website are manufactured and/or provided by Independent Suppliers of the Program Administrator. To the extent permitted by law, neither the Program Administrator nor the Program Sponsor makes any guarantees, warranties, or representations of any kind, expressed or implied, with respect to the products - including warranties of merchantability, fitness for a particular purpose or otherwise.
    2. By ordering rewards using the Program Website, you accept any conditions generally associated with the goods or which are stated on the Program Website in relation to those goods at the time of ordering.

1. Digital Gift Cards

Please note: Digital Gift Cards from multiple Retailers may be delivered separately. However, if you have not received the correct Digital Gift Card quantity from the brand/supplier ordered, please contact The Program Administrator within 24 hours of receipt.

  1. Digital Gift Cards are treated as cash. Defaced, mutilated, altered, lost or stolen Digital Gift Cards will not be replaced, or refunded.
  2. Digital Gift Cards are redeemable for merchandise and/or services at participating Retail Stores only. It is up to you to check where Digital Gift Cards can be used and the retail items available for purchase.
  3. Digital Gift Cards are not redeemable for cash and are not a negotiable instrument.
  4. Digital Gift Cards cannot be reloaded.
  5. Digital Gift Cards must be redeemed before the expiry date shown on the Digital Gift Card (if applicable). It is up to you to use the full value of a Digital Gift Card before its expiry date. Any unused balance after the expiry date of a Digital Gift Card will not be refunded or credited.
  6. Each retailer providing Digital Gift Cards will have their own Terms & Conditions of use. Please contact the Digital Gift Card Retailer for their full Digital Gift Card Terms & Conditions. Neither the Program Administrator nor Program Sponsor are responsible if you cannot redeem a Digital Gift Card for reasons beyond our control - including industrial disputes, insolvency, flood, war or civil disturbance, acts of terrorism, acts of God, aircraft unserviceability or unavailability or for any other reason.
  7. Charity Donations: If you choose to redeem your Reward Points for a donation to a participating Charity, you should make your own enquiries with your Tax Advisor as to whether this entitles you to a tax deduction.
  8. If a Reward Claim has been incorrectly placed, e.g. incorrect Digital Gift Card selected, please contact the Program Administrator within 24 hours to cancel the order. After 24 hours, the Program Administrator is unable to guarantee that the cancellation will be processed – as such, the Reward Claimant is liable for the original Reward Claim.

2. Lifestyle Merchandise:

  1. The description of merchandise on the Program Website will be as detailed and accurate as possible as at the date of inclusion on the Website. Where possible, we will include the model number and product image as a visual reference. We encourage you to undertake further investigations to ensure that your merchandise reward is as expected prior to making your Reward Claim.
  2. In the event that the description does not match the merchandise reward received, you must notify the Program Administrator within 24 hours of receipt of the goods, and we will assess the situation. Please DO NOT open the merchandise packaging if you suspect it is an incorrect reward item.
  3. For reasons outside the Program Administrator’s control, merchandise shown as being available for redemption may subsequently become unavailable. If this occurs, the Program Administrator will either:
    1. Substitute the reward for a direct replacement, if the replacement item is of the same Recommended Retail Price (RRP) and has similar features as the ordered item; or
    2. Refund your ‘Reward Points’ and advise you via a Refund Email. 
  4. Alcohol:
    1. By claiming alcohol from the ‘Choose Your Reward®’ Catalogue you confirm that you are over the age of 18 and can provide proof of age upon receipt of the alcohol.
    2. Delivery of alcohol will be refused to anyone who fails to provide adequate proof of age upon delivery. This also applies to any contact, other than yourself, who signs for your delivery.
  5. Rewards will not be exchanged or refunded due to change of mind.
  6. If a Reward Claim has been incorrectly placed, e.g. incorrect merchandise item selected, please contact the Program Administrator within 24 hours to cancel the order. After 24 hours, the Program Administrator is unable to guarantee that the cancellation will be processed – as such, the Reward Claimant is liable for the original Reward Claim.
  1. Fulfilment of Digital Gift Cards:
    1. Digital Gift Cards will be delivered within the next business day of the order being acknowledged by email to you. If you have not received your rewards within 3 business days of the order being acknowledged, please email us immediately at info@ContiClub.com.au.
    2. Proof of Delivery records are only stored for a limited time by external parties. Please ensure that ContiClub Rewards is contacted in accordance with (a) if you have not received your Reward within the agreed time period.
    3. Digital Gift Cards will be delivered to your nominated email address - and will require you to click through to an online / web link to access the Gift Card as a digital footprint / proof of delivery of you receiving the Gift Card.
    4. If you (and / or other nominated person) do not have adequate access security over your nominated email address at the time of delivery, ContiClub Rewards takes no responsibility for any issues occurring with the delivery / receipt of the Digital Gift Card Reward.
    5. It is solely the responsibility of the individual to ensure that the correct email delivery address is provided at the point of claiming Digital Gift Card Reward/s.
  2. Fulfilment and Delivery of Merchandise;
    1. Rewards will be delivered within 20 business days of the order being acknowledged by email to you. If you have not received your rewards within 20 business days of the order being acknowledged, please contact us immediately on info@ContiClub.com.au.
    2. Proof of Delivery records are only stored for up to 3 months by external parties (e.g. Australia Post). Please ensure that the Program Administrator is contacted in accordance with (a) if you have not received your reward within the agreed time period.
    3. You cannot enter multiple delivery addresses within a Reward Claim. If you require multiple rewards to be sent to multiple addresses, you must claim them as separate orders.
    4. Merchandise ordered through the Program Website will only be delivered to physical residential or commercial addresses within Australia. Post Office Box addresses will not be accepted.
    5. For physical residential/commercial address deliveries, it is up to you to ensure someone will be available to receive and sign for the reward during normal business hours (9.00am to 5.00pm).
    6. If you (or other nominated person) are not present to sign for a reward at the time of delivery, the Program Administrator takes no responsibility for any delay in delivery of the Reward.
    7. If you elect to have a reward delivered to a business address – the reward will be considered to be delivered once a signature is received for that item by any representative of that business e.g. receptionist or a co-worker.
    8. If delivery is attempted but no one is available to sign for the reward a calling card may be left:
      • For merchandise rewards, please contact the delivery company noted on the calling card and arrange for a suitable re-delivery date. You may be held liable for any costs associated with re-delivery of your merchandise.
    9. In some circumstances (i.e. remote location), delivery of large merchandise items may not be possible. Please contact the Program Administrator before claiming to confirm delivery of your reward is possible to your location.
    10. It is solely the responsibility of the individual to ensure that:
      • The correct delivery address is provided at the point of claiming.
      • The claimant responds to Australia Posts request to pick up the parcel from the nominated (local) Australia Post Outlet within the required time.
  3. Costs that are your responsibility
    You agree that you are responsible for:
    1. Organising and paying for any installation of merchandise ordered through the Program.
    2. Organising and paying for storage and re-delivery of merchandise rewards ordered through the Program if you cannot or do not, accept delivery of the reward at the time of initial delivery.
  4. Merchandise Returns:
    1. Merchandise that is not the merchandise reward ordered, or that is damaged, faulty, not new or is of un-merchantable quality - must be advised to the Program Administrator within 24 hours of receipt. It may be returned within 7 days of delivery for an exchange for the correct item.
    2. All merchandise returned under clause 29(a) above must be returned to the Program Administrator (or an agreed alternate address) in new or unused condition with its original packaging, instruction manuals and all accessories.
    3. If merchandise is not returned in accordance with paragraphs 29(a) and 29(b) above, your only right to return the merchandise (if any) is as set out in the Manufacturer's Warranty applicable to that merchandise - as stated in the Manufacturer's Product Warranty. All warranty services will be performed as described in the Manufacturer's Warranty. The Program Administrator and Program Partner do not provide warranty services.
  5. Program and Personal Liability:
    1. The Program Administrator and Program Sponsor shall not be liable for any loss or damage whatsoever suffered (including, but not limited to, indirect or consequential loss) or personal injury suffered or sustained as result of rewards claimed, except for any liability which cannot be excluded by law, in which case that liability will be limited to the minimum amount permitted by law.
    2. Liability for any Tax (including any applicable Fringe Benefits Tax - FBT) arising out of any benefits provided to Participants in this Program is not the responsibility of the Program Administrator or the Program Sponsor and is the sole responsibility of the Participants. Participants should contact their own accountant or taxation adviser in this regard. Neither the Program Administrator nor the Program Sponsor accept any liability or responsibility to reimburse, in part or full, any amount of tax involved.
